INSEN — Terms of Service

1. General provisions and Provider details
1.1. These Terms of Service ("Terms") govern the use of INSEN — the website insen.app and the application dashboard.insen.app (together, the "Service").
1.2. The Service is operated by PMC Tomasz Paśko, a sole proprietorship registered at ul. Żywiecka 14, 34-321 Łękawica, Śląskie, Poland, Tax ID (NIP): 5532328643 (EU VAT: PL5532328643) ("Provider", "INSEN", "we", "us").

1.4. INSEN is not affiliated with, endorsed by, or sponsored by Instagram, Meta Platforms, Inc. or their affiliates.
2. Definitions
- User / Creator – a person using the Service with an account.
- Buyer – a person purchasing a digital product offered by a Creator.
- Account – an individual user profile in the Service.
- Subscription – paid, recurring access to Service features.
- Product – a digital product created and sold by a Creator.
3. Scope of the Service
3.1. INSEN helps creators turn their publicly available Instagram content (Reels and comments) into a searchable knowledge base and into digital products sold through an INSEN-hosted storefront.
3.2. The Service uses AI tools to transcribe, index, analyse content and generate product drafts and audience insights.
4. Eligibility and account
4.1. Use of the Service requires being at least 18 years old and able to enter into a binding contract.
4.2. You are responsible for the security of the email address used to sign in and for activity under your Account.
4.3. You provide accurate information and connect only Instagram handles you own or are authorised to use.
5. Subscriptions, trial and payments
5.1. Plans. Paid plans (e.g. Creator, Creator Pro) are billed monthly in advance at the prices shown in the app. Prices may change with notice, effective for future billing periods.
5.2. Free trial. New Accounts may receive a free trial. After it ends, access to paid features may be restricted unless you subscribe.
5.3. Auto-renewal. A Subscription renews automatically each period until cancelled. You can cancel anytime in billing settings; cancellation takes effect at the end of the current billing period.
5.4. Payment processor. Payments are processed by Stripe. INSEN does not store full card details.
5.5. Refunds. Subscription fees for a period already started are generally non-refundable; however, we review every refund request individually. This does not affect mandatory consumer rights.
5.6. Taxes. Prices may exclude applicable taxes (e.g. VAT), which will be added where required.
6. Selling products (creator storefront)
6.1. Creators can create and sell Products through the Service. Accepting payments requires connecting a Stripe account (Stripe Connect). Until then, a Creator may publish free Products only.
6.2. The Creator is the seller of their Products towards Buyers. The Creator is responsible for the Products, their descriptions, delivery, Buyer support, refunds, consumer-law compliance, and all taxes on their sales.
6.3. INSEN charges a platform fee on paid Product sales, as shown in the app. Payouts are handled by Stripe under Stripe's Connected Account Agreement.
7. Content and intellectual property
7.1. Creators keep ownership of their Instagram content and the Products they create.
7.2. The Creator grants INSEN a non-exclusive, royalty-free, worldwide licence to host, store, process, index, display and transmit their content solely to provide the Service (including AI processing).
7.3. The Creator represents that they hold the rights to the content they connect and sell, and that it does not infringe third-party rights or platform terms (including Instagram's).
7.4. INSEN's software, design and trademarks remain the Provider's property.
8. Acceptable use
You must not: (a) use the Service unlawfully or to infringe others' rights; (b) upload or sell illegal, misleading, infringing or harmful content; (c) breach security, scrape, overload or reverse-engineer the Service; (d) resell or misrepresent the Service.
9. Liability
9.1. The Service is provided "as is". We do not warrant uninterrupted or error-free operation, or that AI-generated output is accurate, complete or fit for a particular purpose. You must review AI-generated content before publishing or selling it.
9.2. To the maximum extent permitted by law, INSEN is not liable for indirect, incidental or consequential damages or lost profits. INSEN's total liability for claims relating to the Service will not exceed the amounts you paid in the 12 months before the event. These limits do not apply to liability that cannot be excluded by law, including mandatory consumer rights.
9.3. Indemnification. You will indemnify INSEN against third-party claims arising from your content, your Products, or your breach of these Terms or the law.
10. Right of withdrawal (consumers)
10.1. A consumer has a 14-day right of withdrawal. For digital content and services, by starting to use paid features before that period ends, the consumer consents to performance beginning and acknowledges losing the right of withdrawal once the service is fully performed.
11. Complaints and disputes
11.1. Complaints may be sent to hi@insen.app and are answered within 14 days.
11.2. Consumers may use out-of-court dispute resolution, including the EU ODR platform (ec.europa.eu/consumers/odr).
12. Changes to the Terms
We may change the Terms for valid reasons. We will notify material changes by email or in the app. Continued use after changes take effect means acceptance; a consumer may then terminate the agreement.
13. Governing law and jurisdiction
These Terms are governed by Polish law, without prejudice to mandatory consumer-protection rules of the consumer's country of residence. The competent court is the court for the Provider's seat in Żywiec, subject to consumer-jurisdiction rules.
